Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and zombieaivideo, the operator of Zombie AI Video ("Zombie AI Video", "we", "us" or "our"), of Core F, Cyberport 3, 100 Cyberport Road, Hong Kong. They govern your use of zombieaivideo.org and the AI video generation service we provide there (together, the "Service").

By creating an account, uploading photos, making a purchase or otherwise using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you confirm that you meet these requirements and that you are not barred from using the Service under any applicable law.

2. Your account

• You must give accurate information when you create an account and keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account.
• Tell us immediately at contact@zombieaivideo.org if you suspect unauthorised use of your account.
• Accounts are personal. You may not sell, share or transfer your account or your prepaid videos.

3. The Service

The Service turns two photos you upload into a short AI-generated video in the style of the "zombie love story" trend. Videos are created automatically by third-party artificial intelligence models.

Because the results are AI-generated:

• Results vary. Likeness, faces, motion, lighting, sound and transitions can differ from your photos and from one render to the next. We do not guarantee that a video will look exactly like the people or pets in your photos or meet a particular expectation.
• Results are fictional. Generated videos depict events that did not happen.
• Processing time is an estimate. Renders usually finish within minutes but can take longer when providers are busy.

We may change, add or remove features, models, story templates, formats or limits at any time. Where a change materially reduces what you have already paid for, we will offer a fair remedy such as returning unused videos or a pro-rated refund.

4. Photos and consent

You are solely responsible for the photos you upload. By uploading a photo, you confirm that:

1. You took the photo or have the right to use it.
2. Every person shown is an adult (18 or over) and has given permission for their photo to be used to create an AI-generated video — or the person is you.
3. Your use of the photo does not violate anyone's privacy, publicity, image, copyright or other rights, or any law.

Prohibited uses

You may not use the Service to upload, create or share content that:

• Shows or appears to show a minor, in any context.
• Shows a public figure, celebrity or politician, or anyone you do not have permission to depict.
• Is sexual, nude, sexually suggestive or exploitative.
• Is intended to harass, bully, threaten, intimidate, humiliate or defame anyone, or to cause distress to the person shown.
• Impersonates someone, or is designed to deceive people into believing that real events took place (for example, fake news, fraud or scams).
• Promotes violence, self-harm, hatred or discrimination against any person or group.
• Infringes intellectual property or other rights, or violates any applicable law.

Sharing your videos

When you share a generated video, you agree to make clear that it is AI-generated where a reasonable viewer might otherwise be misled, and to follow the rules of the platform you share it on.

We may refuse to process, remove or disable access to content, and suspend accounts, where we reasonably believe these rules have been broken. We may report content involving minors or other illegal material to the relevant authorities.

5. Your content and licences

• Your photos. You keep all rights you have in the photos you upload. You grant us a limited, worldwide, non-exclusive, royalty-free licence to store, copy, process and transmit your photos — including to our service providers — only as needed to provide, secure and support the Service.
• Your videos. As between you and us, we claim no ownership of the videos generated for you, and you may use them for any lawful personal or commercial purpose, subject to these Terms and the rights of the people shown. Some jurisdictions may not grant copyright protection to AI-generated material, and similar outputs may be generated for other users.
• No training, no publishing. We do not use your photos or videos to train AI models, and we do not publish them or use them in our marketing without your separate written permission.

6. Acceptable use of the Service

You agree not to:

• Access the Service by automated means (bots, scrapers, scripts) except through features we provide for that purpose.
• Attempt to bypass payments, credit limits, rate limits or security measures, or exploit bugs to obtain free videos.
• Probe, scan or test the vulnerability of our systems, or interfere with or disrupt the Service or its providers.
• Copy, resell, sublicense or offer the Service as part of another product without our written permission.
• Reverse engineer the Service except where the law expressly allows it.

7. Prices, payments and credits

7.1 Plans

The current plans are shown on our Pricing page. Prices are in US dollars and may exclude taxes, which are added where required. At the time of these Terms:

• 1 video — a one-time payment.
• 2 videos — a one-time payment for a pack of two.
• 5 videos — a one-time payment for a pack of five.

7.2 Prepaid videos (credits)

Purchases add prepaid videos ("credits") to your account. Each successful render uses one video.

• Prepaid videos do not expire.
• If a render fails, the video is returned to your account automatically.
• Credits have no cash value, cannot be transferred and are not redeemable for money except as set out in our Refund Policy or required by law.

7.3 Payment processing

Payments are processed by Stripe. By making a purchase, you authorise us and Stripe to charge your chosen payment method for the amount shown at checkout. You also agree to Stripe's terms that apply to the payment.

7.4 No subscriptions

All plans are one-time payments. Nothing renews automatically, and we will not charge your payment method again without a new purchase from you. If you subscribed to our former monthly plan, it renews on its existing terms until you cancel it from the Billing page in your account settings; cancelling stops future renewals, and videos already granted for the current billing month stay usable until the end of that month.

7.5 Refunds and chargebacks

Refunds are handled under our Refund Policy. If you believe you were charged in error, please contact us before disputing the charge with your bank — we can usually resolve it faster. If a charge is disputed, we may suspend the account while the dispute is open and remove credits granted by the disputed payment.

8. Availability and storage

We aim to keep the Service available and reliable, but it is provided over the internet and depends on third-party providers, so it may sometimes be unavailable, slow or interrupted. Finished videos are kept in your account for as long as it exists, unless you ask us to delete them. In rare cases where a video cannot be copied to our storage, it remains available from our provider for 14 days. We recommend downloading a copy of any video you want to keep; we are not responsible for loss of stored videos beyond our obligations under applicable law.

9. Third-party services

The Service relies on third-party providers, including hosting, storage, AI model and payment providers. Their services are subject to their own terms, and we are not responsible for their acts or omissions beyond our obligations under applicable law.

10. Our intellectual property and independence

The Service — including its software, design, text, graphics, story templates, example videos and the Zombie AI Video name — belongs to us or our licensors and is protected by intellectual property laws. Except for the rights to your own content described in section 5, these Terms do not grant you any rights in it.

Zombie AI Video is an independent tool. It is not affiliated with, endorsed by or sponsored by TikTok, Instagram, ByteDance, CapCut, Dreamina, Kling, Higgsfield, PixVerse or Google. Third-party names are used only to describe the trend and compatibility, and belong to their owners.

11. Reporting content and complaints

If you believe that content created with the Service shows you without your consent, involves a minor, infringes your rights or otherwise breaks these Terms, email contact@zombieaivideo.org with a description and any relevant links. We review reports promptly and will act where appropriate, including removing content and suspending accounts.

12. Suspension and termination

• You may stop using the Service at any time and ask us to delete your account by emailing us.
• We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service, other users or third parties.
• While we investigate a suspected breach, we may suspend your account; a suspension alone does not forfeit your credits, and if we find no breach we restore your access.
• If we terminate your account after confirming a serious or repeated breach of these Terms, unused credits are forfeited. Refunds you were already owed before the breach (for example for a failed render or a billing error) are not affected. If we close the Service or terminate your account for any other reason, we will refund unused paid videos.
• Sections that by their nature should survive termination — including sections 5, 7.5, 10 and 13 to 17 — continue to apply.

13. Disclaimers

To the maximum extent permitted by law, the Service and all generated content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes any statutory rights you have as a consumer that cannot be excluded by contract.

14. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or reputation, arising out of or relating to the Service or these Terms.
• Our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

15. Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities and expenses (including reasonable legal fees) brought by third parties, to the extent they are caused by your breach of these Terms, your breach of the law or of anyone's rights (for example uploading a photo of someone without their consent), or the way you share videos you created. This does not apply to the extent a claim is caused by our own fault or that of our service providers.

16. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. The courts of Hong Kong have exclusive jurisdiction, except that nothing in this section deprives you of the protection of mandatory consumer laws of the country where you live, or of the right to bring a claim in your local courts where such laws allow it.

Before starting formal proceedings, please contact us at contact@zombieaivideo.org so we can try to resolve the issue informally within 30 days.

17. General

• Changes to these Terms. We may update these Terms from time to time. We will change the "Last updated" date above and give notice of material changes on the site or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
• Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service.
• Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a transfer of the Service, provided your rights under these Terms are not reduced.
• Language. If these Terms are translated, the English version prevails.
